Auction Rules:
1. General Provisions
1.1 The organizer of the auction is SIA "OLD YARD" Reg Nr: 41203057253
1.2 SIA "OLD YARD" (Organizer) carries out activities for the sale of antiques and art to interested parties (Buyers)
1.3 When preparing and holding auctions, the Organizer is guided by the current legislation of the Republic of Latvia, as well as its own Charter and these Rules
1.4 SIA "OLD YARD" acts as an agent of the Seller
1.5 The official website of the Auction Organizer is located at: www.vialiti.com
2. Explanation of terms used in the auction rules
Auction - the sale of works of art and antiques at auctions, which are organized online on the website www.vialiti.com, at the end of the auction, the items are considered sold to the buyer whose bid is the highest.
Auction house - a legal entity that organizes an auction and is entitled to a fee (Commission) for organizing the sale.
Commission - remuneration of the Auction House under this agreement, expressed as a percentage of the amount for the lot won at the final price of the auction.
Lot - an item put up for auction in the Auction House, which is assigned:
- Lot number on the website: www.vialiti.com
- Photo of the lot
- Starting or current (last) price
- Description of the lot
- The date of the beginning of the auction and the date of the end of the auction.
The Auction House has the right to remove any lot from the auction before the announced start of the auction without giving reasons, while the Auction House categorically does not remove lots for the purpose of selling before the auction.
Seller - a person who delivers or delivers an item to the Auction House for sale and confirms that he has full rights to sell the item. The auction house has the right to refuse to put the item up for auction without motivating its decision.
The buyer is an auction participant, a capable individual who has reached the age of majority, as well as a legal entity.
The Auction House reserves the right to refuse participation in the auction to the Buyer without motivating its decision.
Confirmation of the bid - means the unconditional and irrevocable consent of the buyer to buy the Lot put up for auction at the price of the won lot.
Reservation Price or Reserve - a confidential amount agreed between the Auction House and the Seller. Below this amount, the Lot is not for sale.
Starting price - the price at which the auction starts. It usually corresponds to the Reserved Price of the Lot or the Appraisal.
Final price - the price at which the auction ends.
Lot won - the lot purchased after the end of the auction.
Bid – an increase in the price of the Lot by one step or an indication of a specific amount that the buyer undertakes to pay for the Lot.
Step Interval:
The buyer independently sets the bid step.
Auction with extension – if the leader change occurred within the last 10 minutes before the declared end time of the auction, then the system will activate the auction extension for 10 minutes from the moment of the leader change, and so on with each subsequent change of the auction leader. The auction is considered completed if there has not been a change of leader within the last 10 minutes. A change in the current lot price, if there is no leader change, does not extend the Auction.
Unsold Lots - Auction withdraws from auction or puts up in the online store www.vialiti.com
Registration - to register a user at the auction, you must go through the process of entering personal data in the registration section, to participate in the auction, you must sign a bilateral agreement on participation in writing with him, or confirmation of familiarization and agreement with the rules of the auction in electronic form. The choice of procedure for concluding a contract is made by a representative of the Auction House.
3. Rights and Obligations of the Buyer
3.1 The Buyer is obliged to read the Auction Rules before the auction.
3.2 The Buyer, in case of winning the auction, is obliged to pay for the lot/lots + Auction House Commission, in accordance with the clauses of the rules Payment and Delivery of lots. Also, if it is necessary to deliver the lot, the buyer is obliged to pay the cost of delivery in accordance with the rules in the Payment and Delivery of Lots paragraph.
3.3 In case of legitimate and justified claims of the Buyer regarding the authenticity of the lot won, the Buyer, within one week after receiving the Lot, has the right to apply to the Auction House with a request to refund the full amount from the Seller on a voluntary basis.
3.4 The buyer has the right and obligation to personally familiarize himself with the condition of the lot before taking part in the auction, if it is not possible to inspect the lot in person, the participant has the opportunity to request additional information or photos of the lot in the "ask a question" form, which is present in each lot.
3.5 The Buyer, who has made a bid, thereby confirms that he has familiarized himself with the lot and has no claims.
4. Rights and Guarantees of the Auction House
4.1 The auction house conducts auctions in accordance with the auction rules.
4.2 The auction house is obliged, upon receipt, provided for in the Payment and delivery of lots in full, at the request of the participant, to transfer or deliver the paid lot / lots.
4.3. The auction house guarantees the secrecy of information about the names and location of customers, the lots they purchased and their value, except for the case: if such information is reasonably requested by law enforcement agencies.
4.4 If, within one week of receipt of the lot, the Auction House receives notice in writing from the Buyer that the purchased item is a fake, and this is confirmed by convincing facts, the Auction House undertakes to apply for a full refund from the Seller on a voluntary basis.
4.5 In the event of interruptions in the operation of the site at the time of the end of the auction, the auction house has the right to postpone the date of the end of the auction. In this case, the Auction House undertakes to notify all participants of the date of transfer of the auction by e-mail. mail and / or posting information on the site www.vialiti.com
5. Payment and delivery of lots
5.1 The Buyer undertakes to pay for the won lot/lots within 12 days from the end of the Auction. For each overdue day +1% to the commission of the Auction House.
Example: The lot is paid in 20 days, the commission to the final price is 15% + 8% for overdue days.
The seller has the right to take back his lot/s if the buyer has not paid the invoice within the specified period (20 days from the end of the Auction).
5.2 The buyer undertakes to pay the full cost of shipping and packaging of the won lot/lots.
5.3 Payment and method of delivery is negotiated individually with the buyer.
5.4 Types of delivery:
• 5.4.1 personal meeting at the Auction House, free of charge;
- 5.4.2 delivery by courier in Riga to the specified place, payment depends on the weight and dimensions of your purchase
- 5.4.3 delivery to any specified point in the world, the delivery fee in this case is calculated based on the distance, weight and dimensions of the goods purchased by the Buyer.
- 5.4.4 Other types of delivery are negotiated in advance before participation in the Auction by phone or email.
5.5 All risks associated with the transportation of the lot from the moment of dispatch of the lot / are assumed by the Buyer. The Auction House does not recommend shipping items such as china, glass, or other fragile items that are more likely to break during transit.
5.6 Unpaid invoices will be turned over to a debt collection company for further administration.
5.7 If the Buyer buys the Lot, pays the invoice and does not collect the Lot within 14 calendar days after the auction, the Auction House will arrange for the Lot to be stored for 30 days. After 30 days, the buyer loses all rights to the won Lot.
5.8 If the Buyer refuses to redeem the lot, his further participation in the auction may be suspended until the fulfillment of obligations to the Auction House in full. The lot/lots cannot be transferred to the buyer until the lot is paid in full.
6. Auction house commission
6.1 Commission - the amount of remuneration, which is a percentage of the price of the winning bid, which must be paid to the Auction House for the services provided in the auction.
6.2 The commission from the buyer is 15% of the price of the won lot/lots.
6.3 The commission from the seller is 15%, or it is determined in the contract with the seller.
6.4 Auction House commissions are subject to change. In the event of a fee change, the Auction House undertakes to notify buyers of the changes.
*Example: The final price of the auction is 100 Euro + 15% commission in total, the buyer must pay 115 Euro + shipping costs for the lot.
7. Auction Rules
7.1 The auction is held according to the local Latvian time.
7.2 The auction is held in Euro currency
7.3 Payments are accepted in Euro currency, in individual cases (Prearranged between the representative of the auction house and the buyer) in which the buyer cannot pay in Euro currency, the conversion takes place at the agreed rate on the day the lot is paid
.7.4 All lots are exhibited for review in the showroom simultaneously with the placement of the lot on the website www.vialiti.com
7.5 The Auction House sends a newsletter about the auction to the specified e-mail. buyer's mail two weeks before the start of the auction.
8. Miscellaneous Rules
8.1. The Auction House has the right to process the data submitted by the Buyer. The Auction House guarantees the confidentiality of data, and undertakes under no circumstances to disclose any kind of information about the Buyer, unless such information is reasonably requested by law enforcement agencies.
8.2. The Auction House is not responsible for losses arising from force majeure circumstances and other circumstances beyond the control of the Auction House.
8.3. The Auction House has the right, without any restrictions, to use the image, description and price of the Lot in its materials.
8.4. In case of technical problems, in the last hour of the auction, the Auction House has the right to extend the auction for a day.
8.5. Without special agreement with the Auction House during exhibitions and auctions, photographing and filming is prohibited.
8.7. The Buyer is obliged to familiarize himself with the condition and quality of the Lots of the auction.
9. Procedure for resolving disputes
9.1 All disputes and disagreements arising from non-compliance with these Rules are resolved through negotiations. If both parties do not come to an agreement through negotiations, the dispute is resolved in the court of the Republic of Latvia in accordance with the legislation of the Republic of Latvia.
